Buying a Fox Valley Airbnb? Check the Property Before the Income
Short-term rental rules change across town lines. Start with the address, the actual rental plan and written confirmation before relying on projected income.
Research reviewed October 28, 2026. Property eligibility requires confirmation.
You find a home that looks like a good Airbnb investment. The price works, the photos look promising and the projected bookings make the payment feel manageable. Before getting attached to that income, there is a more basic question: can you legally operate that rental at this address?
Across the Fox Valley, the answer depends on the governing jurisdiction, zoning, the type of rental and the approvals attached to the property. Renting a room in the home where you live can be a different use from buying a separate house to rent to guests while you live elsewhere.
This comparison was researched October 28, 2026. It separates current published requirements from older guidance and unresolved questions. It is a starting point for checking a purchase, not a determination that a particular parcel qualifies. No municipal contacts or individual property approvals were obtained for this article.
First, identify who actually governs the property
A mailing address is not enough. Start with the parcel identification number and confirm whether the property is inside a city or village, or in an unincorporated part of the county. Then verify the zoning district and any planned development or property-specific conditions.
Unincorporated Kane County has its own licensing program. That does not mean a house inside Campton Hills, Batavia or another municipality can use the county program instead of meeting municipal rules. Unincorporated Kendall County is a separate review with its own 2026 amendment.
Describe the business before asking whether it is allowed
Give the planning department a concrete description: entire home or individual rooms, whether the owner or operator lives there, minimum and maximum stays, number of guests, parking and who responds to complaints. Include any separate unit, accessory building or outdoor gathering plan.
Ask which use category applies to that exact arrangement. A yes for a hosted bed-and-breakfast does not answer a question about an absentee whole-home rental. A general rental license does not settle whether transient lodging is permitted.
Town-by-town research: what is established and what to verify
All locations below are in Illinois. “Unresolved” means this review has not established a current answer. The source column identifies whether the linked record is current posted guidance, an adopted text, historical material or a verification starting point.
| Jurisdiction | Evidence and limits | Before purchasing |
|---|---|---|
| Unincorporated Kane County | Current county licensing program
The county requires registration and a license for short-term rentals outside municipal boundaries. Its portal links Ordinance 26-038, adopted in January 2026. A license does not replace zoning compliance. County registration portal and ordinance link |
Confirm that the parcel is unincorporated, that the proposed use complies with zoning and that the property can satisfy the license and inspection requirements. |
| Campton Hills | Prohibition in adopted 2024 zoning text
Section 7.3N of the December 3, 2024 zoning ordinance prohibits short-term rentals as a principal or accessory use in all zoning districts. Adopted zoning ordinance, section 7.3N |
Do not underwrite an ordinary home purchase on an STR plan. Verify the applicable current text and any claimed property-specific rights directly with the village. A mailing address near Campton Hills is not proof of village jurisdiction. |
| Oswego | Published special-use and annual-license process
The village defines this category as stays of seven to 30 days. Village Board special-use approval comes before the license. The published annual fee is $2,000, with annual inspections and at least $1 million in guest liability coverage. Village short-term rental instructions |
Confirm the parcel and operating model before applying. The village estimates about three months for the special-use process and expressly says approval is not guaranteed. A weekend-only strategy would conflict with the published minimum stay. |
| Yorkville | Current UDO definition depends on primary residence
The current online definition describes a single-family home occupation using a primary residence of owners or renters, rented for less than 30 days. Residential use-table entries must be read together with that definition. Current online UDO definition |
Ask whether a dedicated, non-primary-residence investment property fits an authorized use. Residential use-table entries alone do not remove the primary-residence language. Older draft stay limits are not used here. |
| Batavia | Operator-occupied B&B category verified
The current posted licensing definition covers an operator-occupied residence with no more than five guestrooms. The operator must live in the establishment or on contiguous property. Posted code, B&B definitions |
Have the city classify the exact rental model and identify zoning and licensing approvals. This hosted B&B category does not establish permission for an absentee whole-home rental. |
| Geneva | Tax obligations verified, parcel eligibility unresolved
The city expressly includes Airbnb and Vrbo in its Hotel/Motel Use Tax guidance. It states a rate of 5% of 94% of gross rental receipts and says those platforms do not collect this local tax. City tax guidance |
Obtain a separate zoning determination. A tax payment or tax account does not establish permission for the use. Verify filing responsibilities with the city and your tax adviser. |
| St. Charles, Illinois | Historical guidance and proposal, current outcome unresolved
June 2025 staff materials distinguished hosted B&B use from other transient rentals and described uncertainty for residential operators. Later 2025 minutes discussed returning with a registration proposal. June 2025 staff packet, historical guidance |
Request the current adopted ordinance and a written classification for the property. This review has not confirmed whether that proposed program was subsequently adopted. Neither blanket permission nor a blanket ban is established here. |
| Sugar Grove | Current STR classification unresolved
Earlier municipal survey material described STRs as hotels and restricted their residential use. That historical description is not a current property approval or a verified village-wide ban. Posted village code, starting point for verification |
Ask which current lodging or residential use category applies, in which zoning districts, and whether a special use is required. Confirm the answer for the proposed hosted or whole-home model. |
| North Aurora | Published home-occupation exclusion, full current treatment unresolved
The village's October 2024 home-occupation application expressly lists short-term rentals among uses prohibited as home occupations. Earlier staff records also raised residential-use restrictions. Village application, page 3 |
Do not treat a home-occupation application as a path to approval. Request the current zoning classification and permitted locations for the exact use. The form alone does not establish a prohibition in every district. |
| Elburn | Historical special-use approvals confirmed
June 19, 2023 board minutes record STR special-use approvals for 113 N. Babcock Street and 309 W. Shannon Street, and state that STRs had been approved as a special use in residential districts. June 19, 2023 approved minutes |
Obtain the current final zoning provisions and any parcel-specific ordinance. Confirm conditions, revocation rules and whether approval survives a sale or operator change. Those historical approvals do not approve another address or establish transferability. |
| South Elgin | Current direct eligibility unresolved
A June 2025 neighboring-city survey reported no dedicated STR regulation. This review has not established the current direct zoning treatment for a particular South Elgin property. Posted village code, verification starting point |
Ask planning staff to classify the proposed use under current code. The absence of a dedicated STR chapter or a search result is not permission. |
| Aurora, Illinois | General rental program verified, STR classification unresolved
The city publishes rental licensing and inspection information. That general program does not, by itself, answer whether a particular property may operate as transient lodging. City rental ordinance information |
Confirm STR zoning, licensing and operating conditions for the exact address and stay pattern. Use Aurora, Illinois records when evaluating this property. |
| Montgomery, Illinois | Current direct eligibility unresolved
This review has not established definitive current STR permission or prohibition. Older regional surveys do not settle today's rules. Historical 2022 regional survey only |
Obtain the current municipal zoning classification, required approvals and any operating conditions before counting STR revenue. County licensing rules cannot be substituted for village requirements. |
| Plano, Illinois | Current direct eligibility unresolved
This review has not established definitive current STR permission or prohibition for Plano, Illinois. Posted Illinois city code, verification starting point |
Request the city's current zoning determination and required approvals. Rules for Plano, Texas do not apply to an Illinois purchase. |
| Unincorporated Kendall County | February 2026 amendment adopted, full terms unresolved
The county's 2026 ordinance register lists Ordinance 26-06, adopted February 17, 2026, amending STR zoning and licensing provisions. The full adopted amendment was not retrieved for this review. County ordinance register, adoption entry |
Obtain Ordinance 26-06 and the current consolidated requirements from the county. Do not rely on a pre-amendment fee, occupancy limit or approval process. Confirm that the parcel is outside municipal limits. |
A practical buyer checklist before relying on STR income
1. Get a written property-specific answer. Provide the address, parcel number and operating description to the correct planning or zoning office. Ask for the current code sections and any required special use, license, inspection or other approval. Clarify whether the answer is preliminary guidance or an approval.
2. Read the actual approval documents. If the seller says the home is already approved, request the ordinance, license, conditions, inspection history and any enforcement notices. Ask whether a sale, new operator or changed rental model requires another application. Do not assume an existing online listing or a seller's license passes to you.
3. Check restrictions outside municipal code. Have the applicable HOA or condo declaration, deed restrictions and lease terms reviewed. Confirm the intended use with your lender and insurance provider. A government approval does not answer those separate questions.
4. Price the operating requirements. Confirm occupancy, parking, minimum stays, safety inspections, insurance, a local contact, renewal costs and applicable taxes. Ask about well, septic or building limitations where relevant. Identify what the platform collects and what the owner must file or pay separately.
5. Test the numbers under the permitted model. Use the stay lengths and occupancy the property can actually support. Include vacancies, cleaning, management, utilities, maintenance, insurance, fees and taxes. A forecast based on two-night stays is not useful if the approved model requires longer stays.
6. Resolve the purchase timing with your attorney. If approvals are essential to the purchase, have your purchase attorney address the needed documents, deadlines and contingencies before you commit. Also evaluate an alternative use on its own merits and confirm that it is permitted. Longer-term renting is not an automatic solution to every zoning or financial problem.
What remains unresolved in this comparison?
The largest research gaps are St. Charles' current adoption status, North Aurora's complete current zoning treatment, Elburn's final current text and transfer conditions, and the full adopted text of Kendall County Ordinance 26-06. Direct current eligibility also remains unresolved for South Elgin, Montgomery and Plano, and for the specific STR model in Aurora and Sugar Grove.
Those are unanswered questions, not findings that rentals are permitted. Geneva's tax instructions and Batavia's hosted B&B definition answer narrower questions. Yorkville's primary-residence language needs attention if your plan is a separate investment house.
The useful next step is to turn the general idea into an address and a written operating plan, then collect the current answers before making the purchase depend on income the property may not be authorized to earn.
Questions you may be asking
Does an Airbnb listing prove a Fox Valley home is approved?
No. Request the actual approvals and conditions, and confirm whether they apply to your ownership and proposed operating model.
Can an incorporated property use Kane County's unincorporated STR license?
The county program described here applies to unincorporated Kane County. Confirm the parcel boundary and the requirements of the municipality that governs an incorporated property.
Does paying Geneva's lodging tax establish zoning permission?
No. Tax compliance and zoning eligibility are separate questions. Obtain a property-specific zoning answer.
Is a hosted B&B the same as an absentee whole-home rental?
They can fall into different local use categories. Batavia's posted B&B definition requires an operator-occupied residence, with the operator living onsite or on contiguous property.
Does this table confirm that every listed town allows or bans STRs?
No. The table identifies the evidence found and the questions still unresolved. Historical guidance, proposals and general rental rules are not substituted for current STR eligibility.
What should a buyer obtain before relying on short-term rental income?
Confirm the governing jurisdiction, current zoning classification, required approvals, operating limits and transfer conditions. Review private restrictions, financing, insurance, costs and contract protections for the specific property.
